Witherspoon turned himself into the Springfield Police Division at 12:14 a.m. on Tuesday, a news release from Springfield stated.
The charges were filed following the fatal shooting of Antoine Crooks, 32, and the wounding of three others.
Police were called to the Speedway just before 1:30 p.m. Saturday, and they found multiple people had been shot. In addition to Crooks, a woman who was identified as Tiffany Brugler, 41, of Springfield, a 6-year-old boy and a 7-year-old girl were also shot.
Brugler, a woman that police said was Witherspoon’s ex-girlfriend, was taken to Miami Valley Hospital in critical condition.
According to Clark County Common Pleas Court documents, Brugler filed a petition for an order of protection against Witherspoon in March of 2013 on behalf of herself, two daughters and a son following an alleged altercation with Witherspoon.
Brugler and her children were staying with family, and upon her return to the area for an appointment, Witherspoon was reportedly waiting for her to drive by a gas station, where he proceeded to chase her, the complaint states. Brugler and her family fled to the Champaign County Sheriff’s Office, who escorted the family to the Springfield Police Division.
“I no longer feel safe in my own home,” Brugler wrote in her complaint. “I fear for my life and the safety of my children.”
Brugler filed for a voluntary dismissal of the petition in July of 2020, according to court documents.
Brugler’s condition is unclear. Miami Valley Hospital and Springfield Regional Medical Center declined to comment on her status Tuesday.
Also injured were a 6-year-old boy and a 7-year-old girl. The boy was taken to Dayton Children’s Hospital with serious injuries, while the girl was taken to Springfield Regional Medical Center and later released.
