Robert Little, 58, was arrested following a traffic stop on Oct. 18, according to an affidavit in the case. An Ohio State trooper said he pulled Little over after noticing he wasn’t staying in his lane.
“I was patrolling northbound on Yellow Springs Street when I observed a red Ford traveling in the opposite direction as me weaving within its lane,” the affidavit says. “As I got closer to the vehicle, I observed it drive over the center roadway line with its left tires. The vehicle then swerved back into the lane in a jerking motion.”
The affidavit says the trooper smelled alcohol when Little opened the door to make contact with him and he failed a field sobriety test.

“On the horizontal gaze nystagmus test I observed six clues including a presence of vertical gaze in both eyes of Mr. Little,” the affidavit says. “I observed lack of smooth pursuit in both eyes…”
A press release by the Ohio State Highway Patrol says this isn’ the first time Little has had trouble with the law.
“Mr. Little has previously been convicted of driving under the influence six times between 1989 and 2003,” the release says.
