Green was indicted in Clark County Common Pleas Court this week on a charge of felonious assault and attempted murder. Clark County Assistant Prosecutor Brian Driscoll said his office planned to charge Green with felonious assault, but after reviewing the video the grand jury elected for a more severe charge.
“When police charge, it goes to our grand jury process,” Driscoll said, “In this case, we presented the evidence to them and we had surveillance video that showed the shooting in pretty good detail as it was in the middle of the day. Then we give them options to vote on and the grand jury at this time decided to indict on attempted murder.”
Springfield police wrote in an affidavit that they began an investigation when they were called to the gas station across the street from Springfield City Schools School of Innovation (also known as the old Keifer building).

There they spoke with the mother of Green’s child who said the shooting took place after Green got in a dispute over visitation time with their son, the affidavit says.
“She said she walked in and saw that the father of her son was in line to pay for his drinks,” the affidavit says. “(She) stated that Green became upset telling everyone in the store that she was keeping the child from him and just taking his money.”
Driscoll said a 8-year-old child was in the car while the gunfire took place.
The video shows an argument taking place in the parking lot of the gas station before shots were fired.
“The video is one key piece of evidence and we have that,” Driscoll said. “There’s no doubt. He can’t change the story because we see exactly what happens. And here we have an individual in broad daylight firing a firearm at an individual multiple times right across the street from a school.”
Green had not been arrested by Friday afternoon and Driscoll said police are asking the community for information of his whereabouts.
Driscoll said Green should not be approached if seen and authorities should be called.
The shooting takes place in the midst of what’s been a high number of violent crimes in the city. Driscoll said law enforcement is working hard to bring violent criminals to justice.

“Springfield Police Division and the Clark County Sheriff’s Office, over the last couple weeks (have handled) several instances of violence,” he said. “They’ve done a great job investigating those cases and we are then taking them to a grand jury and seek the highest penalty we can and we are going to take these to trial.
